Child sitting in sunroof with two adults holding legs going about three miles an hour in a parking lot.

I'm pretty sure I'm missing how this is an offense worthy of jail time.  Maybe a misdemeanor citation of some sort.  I wouldn't do it but I've done other things with my children which are likely much higher risk statistically.  i.e. Ever take your kids swimming?

Compare to toddler sitting on someone's lap going 70 down the freeway.  AFAIK that's not felony child abuse.   

This country and stroh are *humid grottos*.

Clearly the laws need to be rewritten to allow kids to ride on top of a car when it's travelling at less than 5 mph in a parking lot. However, even with this blatantly obvious shortcoming in the law with regard to specifics about when the law should apply or not, perhaps absolute enforcement of the law will prevent a grandmother from allowing her kids to ride atop the car while going 70 down the freeway.
