Pedestrians do not have the right-of-way!!!


Damn it!  There are certain circumstances where at an intersection, crosswalk, or conditions mandate that motorized vehicles yield first to pedestrians.........but there is not a blanket statement, and or *fudge*in' law that states "Pedestrians have the right-of-way"!!!  I'm sick of it!  I'm sick of hearing that phrase!

I'm tired of every Joe *8==>* that wants to cross the road in front of me, or every suburbanite family out for a spring bike ride, thinks I need to come to a complete stop to let their cavalcade cross a thoroughfare with traffic buzzing about!!!

All at the expense of being  "flipped off" , or yelled at!  Learn the *fudge*in' rules yourself!

And while I'm at it.........If I'm turning right onto a 2 lane road, and you're coming at me, and turning left onto the same 2 lane road..........guess what *8==>*head???????  I have the right-of-way!!!!!!  Don't give me a dirty ass look, because you think I'm "sneaking in", and cutting you the *fudge* off!  You're the one who is wrong!

I'm a pedestrian quite a bit during the summer.  You all are quite aware that I don't drive; however, that's not to say that I haven't focused on the driving rules for when the day comes.  When it comes to driving you really have to be offensive and defensive at the same time.  And I think that having that same mindset should be taken on by pedestrians as well.  You are right, far too often pedestrians take for granted the "right-of-way" so much that they think they have it during situations that they don't.  At the same time, drivers aren't always paying attention at the times they should be.  I'd rather give up that "right-of-way" than to be hit.  People should also remember that even if they have the "right-of-way" to be careful because a car will do more damage to you than you could do to it.

Yes, but you went the opposite direction of saying that they "don not have the right-of-way".  You went on to somewhat clarify; however, our lawyer decided to correct your initial statement.

I did not retract my initial statement(post). My rant was the overwhelming thought/mentality of the pedestrians, they, "empirically" have the right of way.  I think our resident barrister was pointing out (I'm assuming) on my latter rant.(I was incorrect)  I, having read the statute several times(thanks to you  ;) ;D) can't find his intent.

Maybe his intent was for you to try to find his intent when he really didn't have an intent. [sm_scratch] ;D

I still think that the point was that there are times they have the right of way.  Of course, it could also have to do with something in the latter part of your post now that I think about it.  Well, whichever he was pointing out, he has gotten you to read Min law several times. :D  And you're welcome. :D

Sorry, I was just giving you the statute, which details those times when the pedestrian DOES have right-of-way as well as those times when he DOES NOT.

(Nothing really happened.  Sort of.  I'll put together a "bit map" of tonight, to better explain.  I'm just tired of trying to drive, and constantly running into these idots(no pun intended)  who have heard that phrase, and think they can run out into traffic whenever they want because.............well............blah, blah blah blah!)

Yep, I did.  :D  The whole rant.  Every word, except for the ones that are filtered out.  That's why I said in one of my posts that you went on to somewhat clarify that you don't mean that they never have the right-of-way, it's just that there are times that they don't have that legal right. 

And don't worry, I'm not one of those "idots" that walk/bike like everyone should kneel before them.  So you won't have to worry about me pulling out in front of you if you ever see me biking somewhere. ;D

Scenario A:

I'm coming home tonight, and make the turn around the 4th green......I see this kid walking toward the street.  It's obvious, he hit his ball over the green, and through the street.  I start to veer to the left, and he never loses stride, headed across the road..I slow down('cause I know he won't), and slam on my brakes, and swerve way left......He raises his club and mouths some words, like it's my fault for not allowing him free pass across the street.........like I almost hit him?  I was an ass for not stopping to let him cross the street?  WTF?



Scenario B: 

Later tonight.  We took Maddie to the park.  Coming home, I signal, slow down, and veer right on the residential street (see graphic)  And I'm talkin about 15 MPH at the most........Karen says  "Hun, they were yelling at you for not letting those people cross."  WTF??!!!  The guy in the truck was at a stop sign!  I was exiting a "Highway"!  (It's St. Francis.  What can I say?  I don't make the rules, I just survive them) 

I can see them being pissed if the truck went, but I can't stop for them..........

Sorry for giving you a hard time about your rant.  It's dangerous when people don't follow the traffic laws.  And it sure would feel horrible to hit someone even when you are the one following the rules. 

On the other hand, I've almost been hit by drivers that aren't paying attention.  Basically, I forgo the "right-of-way" unless the driver indicates that they will let me pass because I don't want to be hit.  I've been in enough accidents in a car and enough near collisions both in a car and on my bike (I can assure you none were my fault) that I don't want to even come close to either happening again.
